Privacy Policy for Poolhouse Games

Last Updated: April 25, 2025

1. Introduction

Welcome to Poolhouse Games’ Privacy Policy. Poolhouse Games (“Company,” “we,” “us,” or “our”) is committed to protecting your privacy. This Privacy Policy describes how we collect, use, disclose, and safeguard your personal information when you use our mobile games, applications, and websites. It applies to all Poolhouse Games games, products and services (collectively, the “Services”). By downloading or using our Services, you agree to the collection and use of your information as outlined in this Policy. If you do not agree with our practices, please do not install or use our apps or services.

We encourage you to read this Policy carefully. If you have any questions or concerns about our data practices, you can contact us using the information in the “Contact Us” section below.

2. Information We Collect

We collect various types of information from and about users of our Services. This includes:

2.1 Information You Provide Directly

2.2 Information We Collect Automatically

When you use our games or visit our website, we and our third-party partners automatically collect certain technical and usage data. This includes:

2.3 Information from Third Parties

We may obtain information about you from third-party sources, which we treat according to this Policy plus any additional restrictions imposed by the source of the data. These sources include:

2.4 Sensitive Information: We do not actively collect any sensitive personal information such as health data, biometric identifiers, or information about your race, religion, or political opinions through our games. We ask that you not send or disclose any sensitive personal data in or through the Services. If you do so (for example, by choosing a username that reveals your religion), that is at your discretion and considered manifestly public.

3. How We Use Your Information

Poolhouse Games uses the collected information for various purposes in support of our business and your gameplay experience. The primary purposes include:

Legal Bases for Processing (GDPR): If you are in the European Economic Area (EEA) or other regions with similar laws, we process your personal data under the following legal bases: (a) Contract – to provide the Services you requested under our Terms of Service; (b) Legitimate Interests – for purposes like improving our games, preventing fraud, and showing ads (we consider and balance your privacy rights when relying on this basis); (c) Consent – where required, we will obtain your consent for specific processing such as certain marketing communications or, in some jurisdictions, for personalized ads; and (d) Legal Obligation – to comply with laws (e.g., maintaining transaction records or responding to lawful requests). You have the right to withdraw consent at any time and the right to object to processing based on legitimate interests (see Your Rights below).

4. Third-Party Services and SDKs

Our games integrate third-party services to enrich your experience and support our operations. These third-party partners may collect information directly through our app (via their SDKs or cookies) and are independent data controllers of that data. We want you to know exactly who we work with and why:

Important: Third-party partners may independently collect and process your data under their own policies. We do not control their data handling, but we do contractually require certain privacy protections and we try to only work with partners who respect user privacy. However, please review their privacy notices. If you have specific questions about any third-party integration, you can contact us for more information.

5. Sharing and Disclosure of Information

We do not sell your personal information to third parties for monetary compensation. However, we do share certain categories of information with third parties in the following circumstances:

Aggregated or De-Identified Data: We may also share information that has been aggregated (grouped with other users’ data) or de-identified (stripped of personal identifiers) such that it can no longer reasonably be used to identify you. This type of data is not considered personal information. For example, we might publish reports or infographics about how many players reached a certain level or the percentage of players from different countries, without any personal details.

6. International Data Transfers

Poolhouse Games is based in the United States, and our Services are accessible globally. When you use our games, your personal information may be transferred to and processed on servers located in countries other than your own, including the United States, Canada, and possibly other jurisdictions where our service providers or partners operate. Different countries may have data protection laws that are different (and potentially less protective) than the laws of your country.

By using our Services, you acknowledge that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy. We will always handle your personal information securely and in accordance with this Privacy Policy, wherever it is processed.

If you have questions about our international data transfer practices, or need more information about the safeguards in place, please contact us (see Contact Us section).

7. Data Security

We take data security seriously and have implemented reasonable and appropriate security measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. These measures include technical, administrative, and physical safeguards such as encryption of data in transit (e.g., SSL/TLS), firewalls and intrusion detection systems, secure server environments with limited access, and regular security assessments of our systems.

Our employees and contractors are bound by confidentiality obligations. We also choose reputable third-party service providers that are required to maintain strong security practices.

Despite our efforts, please note that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to protect your personal data, we cannot guarantee absolute security. It is important for you to also play a role in keeping your information safe. We encourage you to use unique and strong passwords for any accounts and to log out of shared devices after playing. If you suspect any unauthorized access to your account or any security breaches, please notify us immediately.

In the event of a data breach that affects your personal information, we will act promptly to mitigate the impact and will notify you and relevant authorities as required by law.

8. Data Retention

We will retain your personal information for as long as necessary to fulfill the purposes we collected it for, as outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. This means:

When we have no ongoing legitimate business need to process your personal information, we will either delete it or anonymize it. If deletion is not immediately possible (for example, because the data is stored in an off-site backup), we will securely store the data until deletion is feasible.

9. Children’s Privacy

Protecting children’s privacy is extremely important to us. Our Services are not intended for children under the age of 13. We do not knowingly collect personal information from anyone under 13 years of age. If you are under 13, please do not download or use our games, and do not provide us with any personal information.

If we learn that we have inadvertently collected personal data from a child under 13, we will take immediate steps to delete that information from our records. If a parent or guardian becomes aware that their child has provided us with information without consent, they should contact us and we will promptly remove the data and terminate the child’s account if applicable.

For users between the ages of 13 and 18 (or the age of majority in your jurisdiction), we advise that you seek permission from a parent or guardian before using our Services or providing any personal information. Some countries have higher age thresholds (e.g., 16 in parts of the EU) for certain data collection. We will comply with applicable laws regarding minimum age requirements. If we choose to make any of our Services directed to children in the future, we will provide a separate, COPPA-compliant privacy policy and obtain verifiable parental consent as required by law.

10. Your Rights and Choices

You have rights and choices regarding your personal information. Poolhouse Games is committed to enabling you to exercise those rights:

10.1 Access, Correction, and Deletion: You may access and update certain profile information by logging into your account (if the game offers an account management interface). For example, you can change your in-game nickname or email (if applicable) in the settings. If you would like to access or obtain a copy of the personal data we hold about you, or if you need to correct any inaccuracies, please contact us (see Contact Us). We will respond to legitimate requests in accordance with applicable law. You also have the right to request deletion of your personal information.  Keep in mind that if you ask us to delete your data, this may erase your game progress and account permanently, and you may lose any entitlements (like virtual currency or items) that you’ve accumulated. We will inform you of what data can or cannot be deleted (for example, we might retain transaction records if required by law). Once your data is deleted, your account may be closed and you may not be able to recover it.

10.2 Withdrawal of Consent: If we are processing your personal information based on your consent (for instance, for receiving marketing emails or for optional data processing in certain regions), you have the right to withdraw your consent at any time. You can unsubscribe from marketing emails by clicking the “unsubscribe” link in those emails or adjusting your email preferences in the game (if available). For push notifications, you can disable them through your device settings. Withdrawing consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, and it may not affect processing under other legal bases.

10.3 Opt-Out of Targeted Advertising: We support your choice to limit use of your data for targeted ads. You can opt out of personalized advertisements served by many of our ad partners by enabling the appropriate settings on your device or within the game.

10.4 Do Not Sell or Share My Personal Information: As explained, we do not sell personal data for money, but the use of advertising cookies/IDs in our apps could be considered a “sale” or “sharing” under the laws of some jurisdictions. If you are a resident of such a jurisdiction, you have the right to direct us not to sell or share your personal information with third parties for their own purposes. You can exercise this right by using the opt-out methods described above (which we treat as a Do Not Sell/Share request). If our game or website offers a “Do Not Sell My Info” link or toggle, you can also use that. Alternatively, you may contact us at our designated email or webform with your request (see Contact Us below). We do not knowingly sell personal information of consumers under 16 years of age without affirmative authorization.

10.5 Data Portability: You have the right to request a copy of the personal information you have provided to us in a structured, commonly used, machine-readable format, and you can request that we transmit that data to another controller where technically feasible. This right applies only to information you provided, when processing is based on consent or contract and carried out by automated means.

10.6 Verification of Requests: For your privacy and security, when you submit a request to access, delete, or exercise other rights, we may need to verify your identity before responding. For example, we might ask you to provide information that matches what we have on file (such as a recent in-game event or your account ID). If you have an account login, we may ask you to make the request through the logged-in account or respond to an email verification.

If you want to exercise any of your rights, please contact us at the contact information provided below. We will respond to your request within the time frame required by law.

11. Changes to This Privacy Policy

We may update or modify this Privacy Policy from time to time. We will post the revised Policy on our website (and within the app where possible) with a new “Last Updated” date at the top. If we make material changes to how we collect or use your personal information, we will take reasonable steps to notify you (for example, by in-app notification or via a notice on our website or an email, if appropriate). We encourage you to review this Policy periodically to stay informed about our data practices.

Your continued use of the Services after any changes to this Privacy Policy have been posted will signify your acceptance of the updated terms (to the extent permitted by law). If you do not agree to the changes, you should stop using our Services and you may request that we delete your data.
